En 1980, la dictadura militar de Augusto Pinochet buscaba obtener legitimidad. Para mediados de 1980 se presentó el Proyecto a su aprobación mediante plebiscito público. A pesar de haber obtenido más de cuatro millones de votos de los seis millones ejercidos, el resultado fue polémico, puesto que no se permitió a la oposición hacer campaña en contra, además que se le brindaba a Pinochet la facultad de gobernar hasta 1989.El texto quedo dividido en quince capítulos, donde se establece de forma funcional los límites del Estado, las competencias de los Poderes, los deberes y derechos de los ciudadanos. Así como la forma en que conviven Sociedad y Estado.En los periplos del cambio institucional, y ante tentativas anteriores de modificación, la Constitución se presenta como símbolo de una institucionalidad cuestionada, empero atesora los ideales de una parte del Chile contemporáneo.
