During that time, I've had colleagues that committed suicide, had many lawyer friends that ruined their lives through drinking or drugs or other destructive behavior, and others, including a very close friend, that died essentially from the stress of the job. In retrospect, it seemed to me that what many of those tragedies had in common was psychological distress coming from a disconnect between what those lawyers thought the practice of law ought to be and what it is in fact is. It was only in the past few years, through my work with St Andrews, that I came to appreciate that this is in large part a moral problem, and that moral theology has had answers that now seem to be forgotten.How is this a theological problem?In two ways. First, our legal system has lost sight of the fact that it is ultimately grounded in values outside of the system. The legal system, and here I include the legislature, does not have the power to create law out of whole cloth, even if it thinks it does. Laws have to serve the common good. A law that does not serve the common good or that contradicts some other basic understanding of human flourishing is not really a law. Second, the law demands of the lawyer a loyalty that no human institution is entitled to. While the rules of professional conduct allow lawyers to decline work that they find morally offensive, increasingly the law wants to define what is acceptable or not.
